Privacy Policy
Klaientech Inc. ("Klaient," "we," "us," or "our") provides an AI-powered sales intelligence platform that helps businesses understand and improve how their sales teams communicate with customers over WhatsApp. This Privacy Policy explains what data we collect, how we use it, and the rights available to you.
If you are an employee, consultant, or sales representative whose employer uses Klaient, please also contact your employer directly with questions, since they control how your data is used through our platform (see "Controller vs. Processor" below).
1. Who This Policy Applies To
This Policy covers three categories of people:
- Customers: the businesses that subscribe to Klaient ("Customer," "you," when referring to the subscribing business).
- Users: individuals who use Klaient on behalf of a Customer, including managers, administrators, and sales consultants.
- Visitors: people who visit klaient.com or otherwise interact with our marketing without yet being a Customer or User.
2. Controller vs. Processor
Data protection law distinguishes between a "Controller" (the party that decides why and how data is processed) and a "Processor" (the party that processes data on the Controller's instructions).
Customer Data. When Klaient analyzes conversations between a Customer's sales consultants and that Customer's end clients ("Customer Data"), Klaient acts as a Processor. The Customer is the Controller and is responsible for obtaining any consents or providing any notices required under applicable law to their own consultants and end clients before connecting their number to Klaient.
User and Account Data. For account information, billing details, and usage of the Klaient platform itself, Klaient acts as an independent Controller, as described in this Policy.
3. Data We Collect
3.1 Conversation Data. Klaient connects to a Customer's number through the official WhatsApp Business Platform API, provided by Meta. Once connected, Klaient reads message content, timestamps, and sender information for conversations conducted through that number, in order to generate performance reports, coaching suggestions, and related analytics for the Customer. Klaient does not access personal WhatsApp accounts, and only processes messages sent to or from the specific business number a Customer has authorized.
3.2 Account and User Data.
- Name, email address, and phone number of managers and consultants using the platform
- Company name, industry, and business address
- Login credentials and authentication data
- Usage data, such as pages visited within the platform and features used
3.3 Payment Data. Payments are processed by Stripe. Klaient does not store full payment card details; Stripe collects and processes this information directly under its own privacy policy.
3.4 Website and Prospect Data.
- Contact information submitted through forms on klaient.com
- Standard website usage data, such as IP address, browser type, and pages visited
4. How We Use Data
We use the data described above to:
- Analyze sales conversations and generate performance reports for Customers
- Provide AI-generated performance suggestions to sales consultants
- Operate, maintain, and improve the Klaient platform
- Process payments and manage subscriptions
- Communicate with Customers and Users about their account or our services
- Comply with legal obligations and enforce our agreements
Klaient does not sell personal data, and does not use Customer Data to train AI models for the benefit of any party other than the Customer whose data it is.
5. Legal Basis for Processing
Where applicable law requires a legal basis for processing (such as under the GDPR), we rely on one or more of the following:
- Performance of a contract, to provide the services a Customer has subscribed to
- Legitimate interest, in operating, securing, and improving our platform
- Consent, where specifically requested, such as for certain marketing communications
- Legal obligation, where processing is required to comply with applicable law
6. Data Sharing
We share data only with service providers who help us operate Klaient, under appropriate contractual protections. These include:
- Meta, as the provider of the official WhatsApp Business Platform
- Cloud infrastructure and database providers
- AI processing providers, to generate conversation analysis, insights and suggestions
- Stripe, for payment processing
We do not share Customer Data with other Customers, and we do not sell personal data to third parties for their own marketing purposes.
7. International Data Transfers
Klaientech Inc. is incorporated in the United States. Depending on where a Customer or User is located, data may be transferred to and processed in the United States or other countries where our service providers operate. Where required, we rely on appropriate safeguards, such as standard contractual clauses, to protect data transferred internationally.
8. Data Retention
We retain data only for as long as necessary to provide our services, comply with legal obligations, and resolve disputes. Customer Data is retained for the duration of the Customer's subscription and a reasonable period afterward, unless the Customer requests earlier deletion or a longer period is required by law.
9. Data Security
We use technical and organizational measures, including encryption and access controls, designed to protect data against unauthorized access, loss, or misuse. No system can be guaranteed completely secure, and we encourage Customers and Users to use strong, unique passwords and to report any suspected security issue to us promptly.
10. Your Rights
Depending on where you are located, you may have rights under applicable data protection law, including the GDPR (European Union), Colombia's Law 1581 of 2012, or other regional laws. These rights may include the right to:
- Access the data we hold about you
- Request correction of inaccurate data
- Request deletion of your data
- Object to or restrict certain processing
- Request a copy of your data in a portable format
- Withdraw consent, where processing is based on consent
If your data was provided to us by your employer as part of Customer Data, we may need to direct your request to them, since they act as the Controller of that data. To exercise your rights, contact us at contact@klaient.com.
11. Children's Privacy
Klaient is a business-to-business platform and is not directed at, or intended for use by, individuals under 18 years of age. We do not knowingly collect personal data from children.
